GENERAL TERMS OF USE
1. ACCEPTANCE OF THE GENERAL TERMS OF USE
These General Terms of Use aim to define the terms and conditions under which OriginSMP provides its services to the User. The use of at least one of the services offered by OriginSMP by the User implies full and complete acceptance of the hereafter described GTU. Furthermore, the User commits to respecting the rules and regulations governing the sharing spaces between Users within Blocky Studios. OriginSMP reserves the right to unilaterally modify the Content of these General Terms of Use at any time, therefore the User is invited to refer to them as often as possible in order to be aware of them. These texts are available at any time for the User directly on the site www.originsmp.net. In case of non-acceptance of the General Terms of Use detailed here, the User must renounce accessing the Services offered by Blocky Studios.
2. AVAILABILITY AND DESCRIPTION OF THE SERVICES PROVIDED.
The Services offered by OriginSMP are accessible for free in any place and to any User with Internet access. All costs incurred by the User to access the Services (computer hardware, software, Internet connection, etc.) are at their expense. These Services are normally accessible at all times (24/7) to the User, however, access to these Services may at any time be subject to an interruption, a suspension, or a modification without notice for maintenance or for any other case (OriginSMP will then endeavor to communicate in advance to users the dates and times of the intervention). OriginSMP is in no case responsible for these interruptions (voluntary or not) and the consequences that may result for the User. OriginSMP reserves the right to refuse access to all or part of the Services unilaterally and without prior notification to any User, especially in case of a manifest violation of these General Terms of Use. The User acknowledges that OriginSMP cannot be held responsible for any direct or indirect damage occurred due to the deletion of the User's access to the Services. Access to the Services is free, open, and without purchase obligation.
The site www.originsmp.net aims to provide information regarding the entire OriginSMP platform and strives to provide them as accurately as possible. However, OriginSMP cannot be held responsible for omissions, inaccuracies, and deficiencies in the update, whether they are its fault or the fault of third parties partners who provide this information. All information indicated on the site www.originsmp.net is given as an indication and is likely to evolve. Moreover, the information on the site www.originsmp.net is not exhaustive. They are given subject to modifications having been made since they were put online.
3. LIMITATIONS OF LIABILITY
OriginSMP cannot be held responsible for direct and indirect damages caused to the User's equipment when accessing the OriginSMP Services and resulting either from the use of equipment that is obsolete, containing viruses or from an outdated browser, or from the appearance of a bug or an incompatibility. The use of the Services is at the User's own risk, particularly concerning the downloading of data, files, or software that could damage the User's equipment accessing the OriginSMP Services. Blocky Studios's liability cannot be engaged in particular for any loss of data, viruses, bugs, information, or damage affecting their equipment and/or personal data and/or the data of their account.
The Services of OriginSMP are subject to Romanian law. Interactive spaces are available to the User and OriginSMP reserves the right to delete, without prior formal notice, any Content that would contravene the legislation applicable in Romania. Where appropriate, OriginSMP also reserves the possibility of challenging the User's civil and/or criminal liability in case of a message of a racist, abusive, defamatory, or pornographic nature, whatever the medium used (text, photography, etc.).
The different Services of OriginSMP may contain a number of Hyperlinks* to other sites, set up with the authorization of Blocky Studios. However, the existence of a link to another internet site does not allow OriginSMP to verify the Content of the sites thus visited and will not assume any responsibility for their Content. The User is therefore prohibited from engaging the responsibility of OriginSMP concerning the Content and resources related to those outgoing hyperlink links.
Browsing the site www.originsmp.net may cause the installation of Cookie(s)* on the User's computer. The refusal to install a cookie may lead to the impossibility of accessing certain services. The User can, however, configure their browser to block the installation of cookies in the settings.
OriginSMP does not guarantee the adequacy between the Services offered and the expectations of the User. OriginSMP cannot be held responsible for the dissemination of data by the User in violation of rights, particularly proprietary rights, held by third parties. OriginSMP cannot be held responsible for direct or indirect damages such as financial losses, loss of profits, disturbances of any nature whatsoever that could result from the use or the impossibility of using the Services offered. Finally, OriginSMP cannot be held responsible for the use or the impossibility of using the Services offered.
4. INTELLECTUAL PROPERTY AND COUNTERFEITS
The User acknowledges that OriginSMP is with Mojang the sole owner of the Intellectual Property Rights* present on all the Services provided. No provision of these General Terms of Use may be interpreted as granting the User a license on the Intellectual Property Rights, of which OriginSMP may have ownership or the exclusive right of exploitation.
OriginSMP only grants authorization to view its Content for personal and private use, excluding any public viewing or distribution. Therefore, any representation, reproduction, or unauthorized extraction by OriginSMP of the Content as well as any other Intellectual Property Right is strictly prohibited under penalty of legal proceedings. The infringer is exposed to civil and criminal sanctions, in accordance with the provisions of Law no. 8/1996 on copyright and related rights, as republished and subsequently amended.
5. MANAGEMENT OF PERSONAL DATA
In Romania, personal data is protected under Regulation (EU) 2016/679 (GDPR), implemented through Law no. 190/2018, as well as Law no. 506/2004 regarding personal data processing in the electronic communications sector. OriginSMP only collects personal information from users as necessary for certain services offered on the site www.originsmp.net. This information is provided knowingly by the user, and they are informed whether the data is mandatory or optional. In accordance with GDPR and Romanian law, users have the right to access, rectify, erase, restrict, and object to the processing of their personal data, by submitting a written and signed request, along with proof of identity, to the data controller. No personal data of users will be disclosed, sold, or shared with third parties without their consent. If OriginSMP is ever sold or transferred, user data may be passed to the new owner under the same data protection obligations. The databases used by this site are protected by Law no. 8/1996 on copyright and related rights and relevant European legislation.
6. APPLICABLE LAW AND JURISDICTION.
Any dispute related to the use of the Services of OriginSMP is subject to Romanian law. Exclusive jurisdiction is granted to the competent courts of Paris. The duration of the application of these General Terms of Use is indefinite. The contract takes effect with respect to the User from the use of the Services.
GENERAL TERMS AND CONDITIONS OF SALE
1. PURPOSE
These General Terms and Conditions of Sale aim to define the contractual conditions between OriginSMP and the Customer and the conditions applicable to any purchase made through the site store.originsmp.net, whether the Customer is professional or consumer. The acquisition of a good or a service through this site implies unreserved acceptance by the Customer of these General Terms and Conditions of Sale.
2. PRODUCTS AND SERVICES
The products and services offered are those which appear in the catalog published on the site store.originsmp.net. Each product is accompanied by a description established by the supplier. The photographs in the catalog are as accurate as possible but cannot ensure a perfect similarity with the offered product, especially concerning colors.
3. PRICES
The prices appearing in the catalog are prices in Euros, taking into account the VAT applicable on the day of the order. Any change in the rate may be reflected in the price of the products or services. OriginSMP reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the Customer.
4. ORDERS
The Customer who wishes to buy a product or a service must: fill in the identification form or give their Customer number if they have one; fill in the online order form giving all the references of the chosen products or services; validate their order after having checked it; make the payment under the provided conditions; confirm their order and payment. The confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them, and the waiver to invoke its own conditions of purchase or other conditions.
5. PAYMENT TERMS
The price is due at the time of the order. Payments will be made through a secure system that uses the SSL (Secure Socket Layer) protocol so that the transmitted information is encrypted by software and that no third party can become aware of it during transport on the network. The buyer's account will only be debited when the available products or services are shipped, and only for the amount of the products or services sent or downloaded.
6. DELIVERY
Deliveries are made to the address indicated in the order form. In case of damage during transport, a motivated protest must be made to the carrier within three days of delivery. Delivery times are only indicative; if they exceed thirty days from the order, the sales contract may be terminated, and the Customer reimbursed.
7. RIGHT OF WITHDRAWAL
Buyers, non-professional individuals, benefit from a withdrawal period of fourteen days from the delivery of their order to return the product to the seller for exchange or refund without penalty, except for return costs. However, this right of withdrawal does not apply to downloadable digital content immediately executed with the Customer's consent.
8. LIABILITY
The seller, in the online sales process, is only bound by an obligation of means; its responsibility cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruption, or other involuntary problems.
9. INTELLECTUAL PROPERTY
All elements of OriginSMP.net websites are and remain the intellectual and exclusive property of Blocky Studios. No one is authorized to reproduce, exploit, rebroadcast, or use for any reason whatsoever, even partially, elements of the site whether software, visual, or sound.
10. PERSONAL DATA
In accordance with Law no. 190/2018 on measures for the implementation of Regulation (EU) 2016/679 and Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, personal information relating to buyers may be subject to automated processing. OriginSMP reserves the right to collect information on buyers including by using cookies. Buyers may object to the disclosure of their details by notifying Blocky Studios. 11. ARCHIVING - PROOF
OriginSMP will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Law no. 82/1991 (Accounting Law). The computerized registers of Blocky Studios will be considered by the parties as proof of communications, orders, payments, and transactions between the parties.
12. DISPUTE SETTLEMENT
These conditions of online sale are subject to Romanian law. In case of dispute, jurisdiction is assigned to the competent courts of Bucharest, notwithstanding multiple defendants or warranty claims.
